Cookies are small files that websites, online stores, intranets, online platforms, or similar entities store in the user’s browser when they visit them, and they are necessary to provide numerous advantages in web browsing and the provision of interactive services. In general, these technologies can serve various purposes, such as recognizing you as a user, obtaining information about your browsing habits, or personalizing the way content is displayed. The specific uses that MEDIA INVESTMENT OPTIMIZATION, S.A. makes of these technologies are described in section 3.

2.2.-Types of cookies according to the duration of their activity

According to the duration of their activity on the terminal equipment, we can distinguish:

  1. Session cookies: They are usually used to store information that is only of interest to keep for the provision of the service requested by the user on one occasion. They are temporary cookies designed to collect and store information while the user accesses a website.
  2. Persistent cookies: Privacy risks could be reduced with the use of session cookies.
These are cookies in which the data remains stored on the terminal and can be accessed and processed for a period defined by the cookie’s controller, which can range from a few minutes to several years.

2.3.-Types of cookies according to the entity that manages them

According to the entity that manages the equipment or domain from which the cookies are sent and processes the data obtained, we can distinguish:

  1. First-party cookies:these are cookies that are sent to the user’s terminal equipment from a computer or domain managed by the owner/editor of the website and from which the service requested by the user is provided.
  2. Third-party cookies:these are cookies that are sent to the user’s terminal equipment from a computer or domain that is not managed by the owner/editor of the website, but by another entity that processes the information obtained through the cookies.

In case the cookies are installed from equipment or a domain managed by the website owner/editor themselves, but the information collected through them is managed by a third party, they will also be considered third-party cookies.

2.4.-Types of cookies according to their purpose

There are many purposes for the use of cookies. According to the purpose for which the data obtained through cookies is processed, some of the purposes may be:

  1. Technical purposes: these are cookies that allow the user to navigate through a website, platform, or application and use the different options or services available on it, including those that the publisher uses to allow the management and operation of the website and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted access parts, remembering the elements that make up an order, carrying out the purchase process of an order, managing payment, controlling fraud linked to service security, making the request for registration or participation in an event, counting visits for the purpose of billing licenses for the software with which the service works (website, platform, or application), using security elements during navigation, storing content for video or sound dissemination, enabling dynamic content (for example, loading animation of a text or image), or sharing content through social networks.
  2. Customization: these are cookies that allow remembering information so that the user accesses the service with certain characteristics that can differentiate their experience from that of other users, such as the language, the number of results to show when the user performs a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which they access the service, etc. If it is the user themselves who chooses those characteristics (for example, the language), the cookies will be exempt from the obligations of article 22.2 of the LSSI as they are considered a service expressly requested by the user, provided that the cookies exclusively serve the selected purpose.
  3. Analysis or performance cookies:these are cookies that allow the party responsible for them to track and analyze the behavior of users of the websites to which they are linked, including quantifying the impacts of advertisements. The information collected through this type of cookies is used to measure the activity of websites, applications, or platforms, in order to introduce improvements based on the analysis of the usage data that users make of the service.
  4. Behavioral advertising:these are cookies that store information about the behavior of users obtained through the continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.

2.5.-Cookies exempted from regulatory compliance

It is necessary to note that cookies used for any of the following purposes are exempt from compliance with the obligations established in article 22.2 of the LSSI:

  • Allow only communication between the user’s equipment and the network.
  • Strictly to provide a service expressly requested by the user.

In this sense, the GT29, in its Opinion 4/201211, interpreted that among the exempt cookies would be those that have the purpose of:

  1. “User input” cookies (Session and user input cookies are commonly used to track user actions when filling out online forms across multiple pages, or as a shopping cart to track items that the user has selected by clicking a button.)
  2. User authentication or identification cookies (session only).
  3. User security cookies. (For example, cookies used to detect repeated and erroneous attempts to connect to a website).
  4. Media player session cookies.
  5. Session cookies for load balancing.
  6. User interface customization cookies.
  7. Certain plug-in cookies to exchange social content. (The exception only applies to users who have chosen to keep the session open)

Therefore, it can be understood that these cookies are excluded from the scope of application of article 22.2 of the LSSI, and therefore, it would not be necessary to inform or obtain consent for their use.
